I. General Terms and Conditions

§ 1 Basic Provisions

(1) The following terms and conditions apply to all contracts concluded between you and us as the provider (Kasimir und Lieselotte GmbH) via the website www.kasimirlieselotte.de. Unless otherwise agreed, the inclusion of any terms and conditions used by you is hereby expressly rejected.

(2) A consumer within the meaning of the following provisions is any natural person who concludes a legal transaction for purposes that predominantly cannot be attributed to their commercial or self-employed professional activity. An entrepreneur is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their self-employed professional or commercial activity.

§ 2 Conclusion of Contract

(1) The subject matter of the contract is the sale of goods.

(2) By placing the respective product on our website, we submit a binding offer to conclude a contract under the conditions specified in the product description.

(3) The contract is concluded via the online shopping cart system as follows: The goods intended for purchase are placed in the “shopping cart”. You can access the shopping cart via the corresponding button in the navigation bar and make changes at any time. After accessing the checkout page and entering your personal data as well as payment and shipping details, all order data will be displayed again on the order overview page.

If you choose an instant payment system (e.g. PayPal / PayPal Express, Amazon Payments, Postpay, Sofort), you will either be directed to the order overview page in our online shop or first redirected to the website of the respective payment provider. After completing the payment process, you will be redirected back to our shop to the order overview page. Before submitting the order, you have the opportunity to review, change, or cancel all information. By submitting the order via the “Buy” button, you legally accept the offer, thereby concluding the contract.

(4) Requests for quotations are non-binding. We will provide you with a binding offer in text form (e.g. by email), which you may accept within 5 days.

(5) Order processing and transmission of all information required in connection with the conclusion of the contract are carried out partly automatically by email. You must therefore ensure that the email address you provided is correct, that receipt of emails is technically ensured, and in particular not blocked by spam filters.

§ 3 Right of Retention, Retention of Title

(1) You may only exercise a right of retention insofar as it concerns claims arising from the same contractual relationship.

(2) The goods remain our property until full payment of the purchase price has been made.

§ 4 Warranty

(1) The statutory warranty rights apply.

(2) As a consumer, you are requested to check the goods immediately upon delivery for completeness, obvious defects, and transport damage and to notify us and the carrier promptly of any complaints. Failure to do so does not affect your statutory warranty claims.

§ 5 Governing Law, Place of Performance, Jurisdiction

(1) German law shall apply. For consumers, this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the country of their habitual residence (principle of favorability).

(2) The place of performance and jurisdiction for all services arising from the business relationship is our registered office, provided that you are not a consumer but a merchant, a legal entity under public law, or a special fund under public law. The same applies if you do not have a general place of jurisdiction in Germany or the EU or if your residence or habitual place of abode is unknown at the time legal action is initiated.

(3) The provisions of the UN Convention on Contracts for the International Sale of Goods (CISG) shall not apply.

§ 6 Protection of Minors

(1) When selling goods subject to youth protection regulations, we only enter into contractual relationships with customers who have reached the legally required minimum age. Existing age restrictions are indicated in the respective product description.

(2) By submitting your order, you confirm that you have reached the legally required minimum age and that the information you provide regarding your name and address is correct. You must ensure that only you or authorized persons who have reached the required minimum age receive the goods.

(3) If required by law, we instruct the delivery service to hand over the goods only to persons who have reached the legally required minimum age and to request identification if necessary.

(4) If a higher minimum age (18 years) is specified in the product description, the above provisions apply accordingly with the requirement of legal adulthood.
